Brief Background of the Real Estate Act, 2016

The Real Estate (Regulation and Development) Bill was passed by the Rajya Sabha on 10th March, 2016 and by the Lok Sabha on 15th March, 2016. The Bill as passed by the Parliament was assented to by the Hon’ble President on 25th March, 2016. The Real Estate (Regulation and Development) Act, 2016 was published in the Official Gazette on 26th March, 2016 for general information. The Real Estate Act, 2016 aims at protecting the rights and interests of consumers and promotion of uniformity and standardization of business practices and transactions in the real estate sector. It attempts to balance the interests of consumers and promoters by imposing certain responsibilities on both. It seeks to establish symmetry of information between the promoter and purchaser, transparency of contractual conditions, set minimum standards of accountability and a fast-track dispute resolution mechanism.

Brief Background of the Draft Rules under the Real Estate Act, 2016

Specified sections of the Real Estate (Regulation and Development) Act, 2016 have come into effect from 1st May, 2016, including section 84 of the Act which provides that “the appropriate Government shall, within a period of six months of the commencement of this Act, by notification, make rules for carrying out the provisions of the Act” i.e. by 31st October, 2016. As per section 2(g)(i) of the Act, the Ministry of Housing & Urban Poverty Alleviation is the appropriate Government for Union Territories without Legislature.

In this regard, the Ministry has prepared the draft Rules on which the Ministry proposes to elicit general comments through the open forum for discussion on the MyGov portal.

dearmodiji, it seems aadhar to be made compulsory for all train bookings. so many people are still to get aadhar. it will be better if some other id proof like pancard are included. so many office and factory goers could not regster for aadhar. it will be good if aadhar issuing staff visit major office and factories with prior intimation so that who could not register can get aadhar cards. thank you.

proposed rules
1 there should not be direct sale as present laws , this generates black money .
all property deals , land deals , factory deals should be by auctions only .
notified , may be one month prior to proposed sale of given property , so that no black money is generated .
2 all property dealers must be registered with income tax numbers .
they must give details of aadhar card of dealers , tax paid in the dealers commission

4: Regulate middleman(Broker) role as they are the front face and main cause of false commitment, mention the name of authorized brokerage firm in document/Portal.
5: It has been observed for transaction such as resale of house, Brokerage firm hide their income and evade tax. Make compulsory declaration of Brokerage firm and brokerage amount of resale in document and make compulsory online transaction for them.

Sir, My views is as mentioned below:
1:On the name of maintenance of the building, common area and for providing basic amenities builder(or some assigned agency ) charge arbitrary amount and do not provide satisfactory services. We must include minimum standard of services to be ensured by builder after handover.
2:Common portal from where one can fetch information about the builder, builder project record, approvals and project stage.

PFB my comments or feedbacks as consumer . This is based on ongoing experiences I have grieved .

1. No Government, Central or State, can prescribe any Rule which is inconsistent with the main Act.
2. Appointment of Regulator/Appellant Authority with public consent.
3. SECTION 4: Draft rules should ensure that the Promoter needs to submit the Original Plans and specifications on the basis of which booking was done along with all the subsequently changed plans, and strict action

tax paid by sellers and buyers and dealers .and aadhar cards of them all .
3 ``will`` of property must be disclosed before hand to avoid fighting by heirs after death of owners .
4 mutations must be made simple .
5 declare as many owners as possible to avoid fighting afterwards .
6 sell the property on demand of any of the share holders .
7.transfer of property should be allowed while the pwnwer is still alive in favour of his heirs

5) The promoter shall take insurance for the Land and Building and shall pay all outgoing statutory taxes such as property taxes, wealth taxes, water taxes, betterment charges, etc to the appropriate agencies till CC/OC and shall assist All Allottees to form their Associations by submitting declarations as per the state acts and laws and also ensure Land documents are bifurcated among all allottees.
