The Department of Empowerment of Persons with Disabilities (DEPwD), Ministry of Social Justice & Empowerment (MSJE), in collaboration with MyGov, invites comments and suggestions from stakeholders and the general public on the draft accessibility standards for the Build Environment sector. These draft standards, which identify non-negotiable rules, have been prepared to strengthen the creation of barrier-free environments in accordance with the Rights of Persons with Disabilities Act, 2016 and relevant rules.

All interested individuals are requested to carefully examine the proposed standards and submit their feedback, comments, and suggestions on the MyGov platform, ensuring that personal details are entered accurately during registration.

If a civil case is filed by the differently-abled in court, it should be completed within one to three years.Global standards should be set in the production of assistive devices, wheelchairs, and prosthetic limbs for the disabled. Counterfeit goods should be eliminated.

The sale of electronic devices that assist the disabled should be monitored.A strong grievance redressal system is needed for the welfare of the disabled.
Special attention can be paid to matters related to the most frequently raised demands. It will help eliminate common factors that cause grievances.
It will help to understand what is needed and implement plans accordingly.‌ Changes in plans can be made and new plans can be created.Government programs should be flexible to accommodate people with disabilities.

Providing facilities for the differently-abled is not a matter of pride or achievement for the government. It is the duty of the government.The govt should ensure thatspecial facilities are provided for the differently-abled in government offices, people's representative bodies, colleges, schools, parks, entertainment venues, courts, police stations, hospitals, shopping malls, public transport stations, etc. They should be instructed to do so within the appropriate time frame.If facilities for the differently-abled are not provided in schools and educational institutions, the recognition should be canceled. Local bodies should issue building permits to improve facilities for the differently-abled in existing buildings free of charge. Building permits for govt ; private public trade, service, and production-related buildings that are frequented by the public should be granted only if facilities for the differently-abled are provided.

Additional categories should be included in the category of disabled people.

People who require lifelong treatment for rare diseases should also be included in this list. ‌‌Livelihood should be ensured. Reservation should be provided in the private sector as well.
If a mother who is caring for a disabled child is in a helpless condition, the government should provide reservation in government jobs. Financial assistance should be provided to become entrepreneurs.Additional funds should be provided for the welfare of the disabled.

Additional reservation should be provided in job opportunities.Additional assistance should be provided to the differently-abled who participate in skill development training.
To ensure political recognition of persons with disabilities, nominated representatives should be appointed in state legislatures, local government bodies, and Parliament.

The NBC guideline for provisioning of accessible toilets at every 30m (Part 3 Page 102 B 9.1/2) is very difficult to achieve practically in any typology. Request to kindly look into this.

Persons with deafness / Hearing Impairment, especially those ones who use Indian Sign Language (ISL) to communicate on day to day basis, need ISL based access to all kinds of information there is - auditory and textual - at all public places (airports, railway / metro stations, bus stops) and on the public transport vehicles.

Ways to create ISL accessibility -
1. Video of ISL interpretation (pre recorded) on TV / display screens to be made available.
2. Where TV / display screen is not compatible with video based ISL accessibility then a QR based video accessibility should be developed wherein deaf people can view information in ISL on their mobile phones.
3. In all lifts / elevators at present, emergency communication is only voice / sound based. Visual and video phones (devices which facilitate both tele and visual conversations) should be added inside all lifts / elevators and connected to control rooms with Video based virtual ISL communication enabled.

Enforce strict e-challan systems for violations. Road design improvements, combined with tech-based enforcement, can reduce accidents, decongest roads, and create a seamless, sustainable, and commuter-friendly transport ecosystem across urban and rural India.

I truly appreciate the initiative taken by the DEPwD and the Government of India in drafting these non-negotiable accessibility standards. Making accessibility mandatory through enforceable rules under Rule 15 of the RPwD Act, 2016 is a powerful and much-needed move.

My humble suggestions:
1. Please ensure regular third-party audits for accountability, including participation from people with disabilities.
2. A public portal to report violations will help encourage citizen involvement.
3. Consider subsidies or tax benefits for private builders who proactively implement accessibility features.
4. Encourage accessibility awareness training among architects, engineers, and municipal officers.
5. Ensure all government websites and mobile apps are also compliant under universal design standards.

I support the implementation of these standards across all sectors and request wide public awareness and strict enforcement.
