Ministry of Communications had initiated a public consultative process to develop a modern and future-ready legal framework in telecommunication.

With 117 crore subscribers, India is the world’s second largest telecommunication ecosystem. The telecommunication sector employs more than 4 million people and contributes about 8% of the country’s GDP.

The existing regulatory framework for the telecommunication sector is based on the Indian Telegraph Act, 1885. The nature of telecommunication, its usage and technologies have undergone a massive change since the era of “telegraph”. The world stopped using “telegraph” in 2013.

In the past eight years, the Government has taken several initiatives for the growth of the telecommunication sector. It is in this context that we have taken up the initiative to restructure the legal and regulatory framework for the telecommunications sector.

The Bill will replace the existing legal framework governing telecommunication in India, comprising of the Indian Telegraph Act, 1885, the Wireless Telegraphy Act, 1933 and the Telegraph Wires (Unlawful Possession) Act, 1950.

In July 2022, a Consultation Paper on ‘Need for a new legal framework governing Telecommunication in India’ was published and comments were invited. Comments have been received from various stakeholders and industry associations.

Based on the consultations and deliberations, the Ministry has now prepared the draft Indian Telecommunication Bill, 2022. To facilitate further consultations, an Explanatory note to provide a brief overview of the Bill has also been prepared.

Citizens are invited to share their comments on the Draft Indian Telecommunication Bill 2022 on the MyGov Platform.

Last date of sending the comments on MyGov platform will be 20th October 2022.

further to my comments....
Selection of fibre optic cable type, number of cores etc, shall be selected based on core required for the current job and cores anticipated for future use and 20% spare cores shall be calculated.

Further to my comments...
Vendor list - VEC( vendor evaluation committe) list shall be followed by licensee/ contractor. in technical clauses vendor list along with codes if any shall be added for all the items (anticipated) shall be included. if any material other than vendor listed item to use, approval shall be taken from owner, for which contractor shall obtain quotation from minimum 3 reputed vendor. selection of such material will be at owners consent.

Further to my coments...

Raising change orders at later (during work execution) is a risky process and it will be a huge loss to the owner and contractor will dictate terms and there will be no much control on contractor. hence preparation of BOQ, Preparation of drawings, inclusion of stringent clauses are much essential and much careful.

further to my comments....
specific clauses shall be added in order to clear the ambiguity , where to use owner supplied material and where contractor supplied material to use. this will help in easy billing. BOQ shall be clear and complete so that , raising of change orders(later) can be eliminated.

Further to my comments....
In technical specs , specific and stringent statement shall be specified so that licensee/contractor should not skid from responsibilities, and should frame and specify stringent clauses so that licensee/ contracror should not use non standard items, only owner approved vendors list to use to choose for purchasing of material. list for latest telecom standards to be specified, any other standards to follow for a specific work to be mentioned very clearly. so that no ambiguity took place and contractor should not be allowed to skid from responsibility.
