In view of the above there is an urgent requirement to liberalize the above MoEF regulation in order to facilitate conducive business environment in India.
The above MoEF regulation is implemented by Customs thru their Circular No.27-2011 dated 4th July 2011, imposing restrictions on import of second hand goods, which has huge impact on industry and trade in general.
These products are very expensive and meant for high end technological applications like Telecommunication, mobile industries, Aerospace, chip design and R&D applications. The imported used equipment also meets the RoHS (Restriction of Hazardous Substances) addendum, which is the certificate for complying with the environmental standards. Hence, these imports do not have any scope for E-Waste dumping in India. ....cont..
Companies having business in R&D, Software development & Technology needs to import second hand capital goods to support their own operations as well as their end customers. These products imported from the respective manufacturing country go through stringent tests & quality control inspections in the manufacturing plant at overseas to ensure these second hand goods are made equivalent to any new product from all perspective to meet customer needs in India... cont..
If this regulation is not liberalized, most of the companies would rethink to make any new investments or enhance their existing operations in India. Further, some companies might even think of relocating their existing operations to outside India.
