As per the provisions in the act, employer needs to exhibit in his establishment; notice containing such extracts of the act, which should be deleted. As per the act employer shall maintain an inspector’s visit book to make record of his remarks, which should be removed. A show cause notice in writing should be issued by any superior than the inspecting authority, to the establishments to place their grounds/defence, before directing them to pay any fines.

Leave register and wage register only should be made mandatory and other registers should be deleted from the Act. Employer should be permitted to maintain these registers in electronic mode and for which special permission need not be required from the concerned Authority. “Form N” (Individual leave book) to be scrapped if the employer is maintaining it online.

Fines and penalties should be imposed based on level of non-compliance and should be collected via online deposit directly into government account. The appearance in the courts for any non-compliance of the act should be abolished and only provision of fines should be kept.

The Shop & establishments act shall be made applicable to the establishments having 20 or more employees, which is also there in various other Acts for ex.: The Factories Act, The Contract Labour (Regulation and Abolition) Act, The Provident Funds and Miscellaneous Provisions Act and Payment of Bonus Act.

SUGGESTIONS TO AMEND SHOPS AND ESTABLISHMENT ACT An option should be available to the establishments to seek ONLINE APPLICATION of any kind whatsoever (alongwith its tracking status option), under all the statutes falling under the Ministry of Industries, Energy & Labour Department or any other department, in addition to the amendment sought by the ministry under rule 6 of the said act.
