The legal system is far from satisfactory. As the litigation drags both parties get fed up but are helpless. Court load and misuse by way of adjournments are primarily responsible.
While the revamp of legal system is the need of the hour, implementation is easier said than done. I have the following adhoc suggestion which can be tried.
1. A separate Compromise court by way of a Pilot implementation be set up in few capital cities
2. Option be given to those parties whose cases are pending for more than 5 years
3. The Presiding Officer should seriously try for a compromise
4. Maximum time given is 6 months
5. There should be no adjournment beyond 15 days each time
6. If compromise not achieved within 180 days, case will be auto-transferred back to original court
This will compel litigants to close at the earliest. This way, at least those cases where parties want solution will get resolved. If the pilot court succeeds, then new courts as required may be added gradually,
