In order to engage with the stakeholders and invite comments from the public at large, the Department of Revenue has decided to make available the draft Model Laws on Goods and Services Tax (GST) in the public domain.

There are two Model Laws on GST which are being put up in the public domain. This discussion pertains to the draft Model Goods and Services Tax Law for the Centre and the States. The draft law can be seen here. You are invited to submit your comments/feedback on the draft law through this discussion on MyGov.in.

To facilitate the analysis of the comments / feedback, you are requested to add a hashtag to your comments. The hashtags should be added using the following scheme:

Use the hashtag #ModelGSTChap1 for comments pertaining to Chapter 1 of the Model GST Law, #ModelGSTChap2 for comments pertaining to Chapter 2 of the Model GST Law, etc.

In case you have more than one suggestion to offer, you may find it convenient to type out your comments in a separate document, with hashtags specifying the Chapters for which the comments are being given. This document can be converted into a PDF and uploaded in the discussion thread.

In respect to GST rules /Act, I want to suggest that, form of return should be simple & small, The details of CGST & SGST and the details of turn over and tax paid on services and goods may be shown differant for analysis and stastical purpose. furhter, calculation of GST value added tax should be also common and simple, while set off of tax can be avail in case of either tax paid in bill or tax paid by bank/cash it should be setoff, qtly return and yearly audit should be provided, best wishes

why are you creating such big mess? its like central CST and state VAT just changes in name. Apart why dont you keep one single pan india law? are you planning to sabotage business in india by making multiple laws? because it seems like that. Apart there is no mention about how agencies like DGCEI,DRI,CEIB will function or will be transformed in what form?

Please make sure the gst takes care of electrically operated vehicles, its spares parts and battery. Please enable it in the tax system website

Separate commissioner or director good, services and both, followed by special commissioner in case of discrepancies.
Appointment of officers through IRS on merit basis

#ModelGSTChap6.
Voluntary registration for GST free of cost without security deposit, one from registration for new companies and start-up.

As per Section 8 of proposed GST Act. Tax may be levided on "a person" if he receipts goods and services which are taxable under section 7(3) (i.e., under reverse charge) for a sum Exceeding Rs. ____ (sum not yet defined) in a year.

As definition of person also includes Individual, that means as an Individual may also become liable to pay GST. Please look into it and devise proper mechanism

Please keep the registration procedures simple and the security deposit to the lowest possible. If I want to register with MVAT to get VAT TIN I need to give 25000 as security deposit which is big amount for small trader. Now government ready to enforce GST and IGST please take care of small trader who wants to enter their business under GST. If possible do not take security deposits from small traders as they are struggling for capital to invest in business.

Section 38 Provision for 80% refund of ITC depletes traders capital and forces him to borrow fund from Banks at Higher rate Effecting his capacity to manufacture on trade. Interest paid to supplier by Gov must be equal to bank rates thus effecting his capital to least.

PLUS FULL TAX IF PURCHASES FROM URD AND INTERSTATE PURCHASES NO INPUT CREDIT 3)ALL LLP AND LTD CO SHOULD DEDUCT 50% TAX FROM SUPPLIER EXCEPT SULLIER IS LTD CO OR LLP OR FIRM AND PROP CO HAVING T.O.MORETHAN 10 CRS DURING PREVIOUS YR 4) IT HELPS GOVT MACHINERY TO EASY RECOVERY -TARGET AND FOCUS ON BIG CO

Please put the exception limit at 25 lacs and also ensure that the business with turnover leads than 2cr need not to maintain books of records so that these limits will be in sync with income tax limits of presumptive taxation under section 44AD of income tax act 1961. Else, small businesses need to maintain book of records for GST which will defeat the benefits given by ITact in this budget. Please keep the GST exception in sync with income tax act....
